Salary Misclassification

Many employers try not to pay overtime by classifying employees as exempt because they are paid a salary. Just because you are paid a salary does not mean you are not also owed overtime.

Independent Contractor Misclassification

Workers may be classified as independent contractors in order to avoid paying them wages and benefits that an employer would owe to a normal employee. Employers cannot avoid paying wages by misclassifying employees as independent contractors.

Regular Rate

Sometimes, employers pay overtime at a rate lower than required by law. An employer may not include all of the employee’s required pay when calculating overtime.

Off-the-Clock Work

Some employers do not pay for all time worked. For example, employers may not pay for time spent preparing for a shift, traveling, or training. Employers are required to pay the employee for all time spent working.

Time Shaving

Employers may not pay for all recorded time or alter times to avoid paying employees for all time worked.

Meal and Rest Breaks

Employees may be required to work through meal and rest breaks without pay, or meal and rest breaks may be automatically deducted, even when an employee has not taken a break.

Delayed Wages

The law requires that employees are paid on time for their work. If an employer has not paid an employee within the time required by law.

Minimum Wages

Some employers do not pay the required minimum wage for all hours worked, under federal or state law.
